The South Carolina Public Service Authority (Seller) accepts bids for various items.
It is the responsibility of the bidder to fully inspect material(s) on which a bid(s) is submitted. The bidder must rely solely on this inspection. For inspections, please contact Investment Recovery at (843) 761-7079 or by fax at (843) 761-4162.
The material is sold "AS IS/WHERE IS" with all faults and defects. The description of the material set forth in a bid request or a resulting sales agreement including any samples furnished to the Buyer by the Seller, is for the sole purpose of identifying the material, and DOES NOT CONSTITUTE A WARRANTY OR REPRESENTATION THAT THE MATERIAL SHALL CONFIRM TO SUCH DESCRIPTION OR ANY CONDITION REFERRED TO THEREIN. Seller warrants only title to material.
SELLER MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESSED, OR IMPLIED, AS TO THE MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ANY OTHER MATTER WITH RESPECT TO THE MATERIAL, whether used alone or in combination with other material.
Seller provides no indemnity of any kinds whatsoever and is to be held harmless from any claim that may arise from the removal, handling, use, disposal or transfer of this material.
Seller expressly reserves the right to reject any or all bids, to waive any informalities or irregularities in the bids received, and to accept that bid(s) which in its judgment best serves the Sellers purpose and interest.
No bid may be withdrawn or modified in any way for a period of ten (10) days after the date set for the opening of bids.
Bids are to be identified by a Sale Number and returned to the address indicated on the bidder response form, no later than the indicated time on the bid closing date. Bids may be faxed to (843) 761-4162.
Any variation in quantity or weight of any item between that listed on the bid and that delivered will be adjusted on the basis of the unit price quoted for such material. No adjustment for variation will be made when material is sold on a "price for the lot" basis.
Title shall pass upon payment in full. Payment shall be made by certified check or cashier's check to the Seller upon receipt of notification of acceptance of bid and before removing any of the material from Seller's premises (unless other payment arrangements are approved by Seller in advance). All sales will be charged state sales tax.
The Buyer shall remove the material at their expense within ten (10) working days after passage of Title.
Seller shall have the right to cancel and award to another Buyer if Buyer fails to make payment as required or remove the material within the stipulated time.
After passage of title to the Buyer, and prior to removal, all risk of loss, damage or destruction from any cause whatsoever shall be borne by the Buyer, except for willful damage or destruction by the Seller or its agents, in which event the only liability of the Seller shall be to refund the portion of the purchase price applicable to the destroyed goods. After award and prior to passage of title, the Seller shall be responsible only for the exercise of reasonable care for the protection of the property and in the event of damage to all or any part thereof the Seller's only liability shall be to reduce the sale price applicable to the damaged goods.
This Bid Solicitation Form supercedes all prior or contemporaneous documents and is the controlling document concerning the rights and liabilities of the parties to the above referenced Sale #.
Seller may require Buyer to acquire appropriate insurance prior to moving, loading, transporting or otherwise handling the material while on Seller's premise.
